By using the app “ Auto Emission Investigator ” you hereby agree with AUTO VERIFICATION TECHNOLOGIES LTD ( “ we “ “us” ) to be bound to these terms and conditions. Please read them carefully.

PURPOSE AND FUNCTION OF THE APP

The "Auto Emission Investigator " app ( “ App “Or “app “) is an App designed to help and assist automotive businesses and traders to specifically help in investigating and evaluating a vehicle's emissions system using a Bluetooth OBD-II device. Accordingly you further agree that you are using the App in an automotive business or trader capacity .

The App carries out a diagnostic evaluation of a vehicle and appraises such things as engine warning light, readiness checks and DTC errors which can help in the overall evaluation of and indicate whether a vehicles emission system is functional or has been tampered with in any way .

It is important and a condition of using this App that it is used as a tool as part of an evaluation process and to help and assist in the overall evaluation and investigation of a vehicles emission system . It is not intended to be used and cannot be relied upon as the only means of evaluating and investigating a vehicles emission system . The App is to designed to help and assist in evaluating a vehicles emission system along with a physical evaluation of a vehicle to help determine whether a full physical and other examination of the vehicles emission system should be carried out and to indicate whether there is a possibility or likelihood that the emission system may not be operational or may have been tampered with and requires further investigation . The App can and should be part of part of an overall process of assisting and enabling the automotive business or trader to determine what to do in relation to that vehicle and to enable the automotive business or trader to decide whether to proceed to continue to engage with or have any business dealings with that vehicle or carry out a further evaluation. It is important to note that only a full physical examination of the vehicle’s emission systems can determine if the vehicle’s emissions system is fully operational or not or has been tampered with . It is also important to note that in some cases a vehicles software may have been accessed by third parties and changed to mask or corrupt the diagnostic features which the App evaluates and relies upon to determine its findings and in which event the App will not work . We cannot accept responsibility or liability if such software changes have been carried out . In which event only a full physical appraisal of the vehicles emissions system will determine its condition and or whether it has been tampered with .

RISK AND RESPONSIBILITY

The use of this app is at your own risk and as already stated in these terms and conditions you should evaluate whether it is suitable for the vehicle you wish to appraise and AUTO VERIFICATION TECHNOLOGIES LTD is not responsible for any damage to your vehicle that may result from using the app.

EXCLUSION OF LIABILITY

AUTO VERIFICATION TECHNOLOGIES LTD is providing this App only on a business to business supply basis and the App is provided to assist and be part of the process of evaluating a vehicles emissions system and AUTO VERIFICATION TECHNOLOGIES LTD full liability in relation to the use of the App by you or other third party using it through you will be limited to the repayment of the fee charged by the App specifically for that vehicle . AUTO VERIFICATION TECHNOLOGIES LTD will not be liable for any other liability and in particular any financial loss , loss of sale , loss of profits , business or economic loss or other financial damages or third party claim against you , including but not limited to direct, indirect, incidental, punitive, and consequential damages, arising from the use of or inability to use the app and or any other consequential use of the App . Users of the app are expected to be in the automotive business and have a basic understanding of automotive systems and OBD-II diagnostics. Misuse of the app or OBD-II device can result in damage to your vehicle.

NO GUARANTEE

The APP relies on and provides information based on the data received from the vehicle's OBD-II system. While the app aims to provide accurate diagnostics, we do not guarantee that the vehicle is functioning correctly or that it will pass any emissions tests. It is part of the process of evaluating the vehicles emission system. To be sure of a full correct evaluation please carry out or instruct a specialist third party to carry out a comprehensive physical evaluation.

MODIFICATIONS TO TERMS AND CONDITIONS

AUTO VERIFICATION TECHNOLOGIES LTD reserves the right to modify these terms and conditions at any time. Any changes will be posted within the app. Your continued use of the app after changes have been posted constitutes your acceptance of the new amended terms and conditions .
